CANCELLATION AND REFUND POLICY
Tour Operator Agreement Clause
Both parties acknowledge the importance of planning, logistics, and mutual commitment when organizing tours and shuttle services.
For this reason, the following cancellation terms apply to all services booked and fully prepaid by the tour operator with Bigfoot Hostel Volcano Boarding and Travel.
Cancellations made 30 days or more prior to the scheduled service date are eligible for a full refund of the amount paid, minus any bank fees, transaction costs, and exchange rate losses incurred.
Cancellations made between 30 days and 72 hours prior to the scheduled service time will be eligible for a 50% refund of the total amount paid.
Cancellations made less than 72 hours prior to the scheduled service time, including no shows, will be non refundable due to operational costs already incurred such as transportation, staffing, guides, permits, and preparation.
All cancellations must be submitted in writing and confirmed by Bigfoot Hostel Volcano Boarding and Travel.
This policy applies to individual services, group bookings, tours, and shuttle services.
Both parties agree that these terms are designed to support fair collaboration and operational sustainability while maintaining flexibility whenever possible.
ACCIDENT WAIVER
AND RELEASE OF LIABILITY
Applicable to Volcano Boarding and All Tours
By confirming a booking with Bigfoot Hostel Volcano Boarding and Travel, the tour operator, on behalf of its clients, acknowledges and agrees that participation in tours, activities, and shuttle services involves inherent risks, including but not limited to physical injury, property loss, illness, or death. These risks arise from terrain, weather, equipment, transportation, actions of other participants, and other conditions that may be beyond the control of Bigfoot Hostel Volcano Boarding and Travel.
Participants confirm that they are physically and mentally fit to participate and have no medical conditions that would prevent safe participation. Participants assume full responsibility for their own safety, well-being, and conduct during all activities and transportation.
To the maximum extent permitted under applicable law in the Republic of Nicaragua, including Law No. 1210 (General Tourism Law), service providers and users are bound by the terms of their agreement, and participants agree that:

Assumption of Risk: Participants voluntarily accept all risks associated with the booked tours, activities, and transportation services.

Release of Liability: Bigfoot Hostel Volcano Boarding and Travel, including its owners, directors, officers, employees, guides, agents, representatives, volunteers, sponsors, and affiliates (collectively “Released Parties”), shall not be held liable for injury, loss, damage, or death arising from participation in any tour, activity, or transportation service, including travel to and from the activity.

Indemnification: Participants agree to indemnify and hold harmless the Released Parties from any claims, demands, liabilities, losses, costs, or expenses arising out of participation in the tours or activities, whether caused by negligence of the Released Parties or otherwise, to the fullest extent permitted by applicable law.

Insurance Recommendation: Participants are strongly encouraged to obtain comprehensive travel and liability insurance covering medical expenses, evacuation, repatriation, personal injury, and tour cancellation. Insurance coverage does not replace this waiver and is recommended to protect participants independent of the services provided by Bigfoot Hostel Volcano Boarding and Travel.

Photo and Media Consent: Participants consent to the use of photographs, video, or film likeness taken during the tours and activities for legitimate promotional or operational purposes.

Scope of Waiver: This waiver applies to the Volcano Boarding tour at Cerro Negro Volcano as well as all other tours, activities, and transportation services offered or facilitated by Bigfoot Hostel Volcano Boarding and Travel.
This waiver and release is intended to be as broad and inclusive as permitted under Nicaraguan law and will be interpreted accordingly. If any portion of this waiver is held invalid, the remainder will continue in full force and effect according to its terms.
PARTICIPANTS UNDER 18 YEARS OLD
For participants under 18 years, bookings are only accepted with consent from a parent or legal guardian. By confirming a booking that includes minors, the tour operator affirms that appropriate consent has been obtained and that the parent or guardian agrees to all terms in this waiver on behalf of the minor.
